Afterwork Momentum LLC operates an SMS communication program for appointment confirmations, scheduling reminders, service updates, and inquiry follow-up.

By submitting your phone number through our website forms and checking the SMS consent box, you agree to receive text messages from Afterwork Momentum LLC related to your inquiry or service engagement. Consent is not a condition of purchase.

• Refunds are not issued for completed setup work or delivered content
• Either party may terminate ongoing services with written notice as specified in the individual service agreement

8. Limitation of Liability

Afterwork Momentum LLC provides services on a best-effort basis. While we are committed to quality and consistency, we are not liable for:

• Indirect, incidental, or consequential damages arising from service use
• Revenue loss, missed inquiries, or business interruption beyond our reasonable control
• Third-party platform outages, carrier delays, or technical failures outside our systems
• Results or outcomes that depend on factors outside our direct control including market conditions, client participation, or platform algorithm changes

Our total liability in any circumstance shall not exceed the total amount paid by the client for services in the three months preceding the claim. Carriers, including but not limited to AT&T, T-Mobile, and Verizon, are not liable for delayed or undelivered SMS messages. Delivery of text messages is subject to carrier network availability and conditions outside our control.

9. Disclaimer of Warranties

Our services are provided on an as-is and as-available basis. We make no warranties, expressed or implied, regarding the fitness of our services for any particular purpose, uninterrupted availability, or guaranteed business outcomes.

10. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of South Dakota, without regard to conflict of law principles. Any disputes arising from these terms or our services shall first be addressed through good-faith negotiation. If resolution cannot be reached, disputes shall be submitted to binding arbitration in Sioux Falls, South Dakota.
